Bcame s.r.l with registered office and operations in Catania (CT), via Monsignor Domenico Orlando, n. 3 (Building D) tax code and VAT number 05663140878 in the person of the legal representative p.t. (hereinafter, also "Bcame s.r.l."), as the owner of the processing of personal data of users/visitors (hereinafter, the "Users") who consult the website www. bcame.it (hereinafter, the "Site"), invites you to take note of this information notice pursuant to Article 13 of EU Reg. no. 679/2016 (hereinafter, "GDPR") on the processing of your personal data, bearing moreover important information on how the aforementioned site is managed, in accordance with the regulations in force and as better specified below.

This information is made exclusively for the website "www.bcame.it"

1. OBJECT OF PROCESSING

The Data Controller will process the personal identification data (by way of example only: name, surname, address, telephone number, Email, etc. hereinafter also "Data") freely communicated by you during access (e.g., through newsletters, information request, consulting request, etc.) of Bcame s.r.l. products and/or in any case of products directly and/or indirectly referable to the latter, or even those data provided by you in order to take advantage of specific services offered by the Site, in addition to those (browsing data) normally accessible by the Data Controller through the computer systems and software procedures in charge of the operation of the site. In the latter case, we refer to those personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes, ex multis, the IP addresses or domain names of the computers used by the users who connect to the site, the addresses in URI (Uniform Resource Identifier) notation of the resources requested, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user's operating system and computer environment.

2. PURPOSE OF PROCESSING

Your Data will be processed lawfully and fairly for the purposes described below. 

A.As for navigation data: (a) to allow theTowner to obtain anonymous statistical information on the use of the Site and to monitor its proper functioning; (b) for security reasons (spam filters, firewalls and virus detection), in order to block attempts to damage the site itself or to cause damage to users, and in any case to prevent harmful activities or activities constituting a crime; c) to perform any other function necessary or instrumental to the operation of the site, including the installation of technical cookies to improve the functionality of the site for which please refer to the Cookie Policyd)to allow theTowner the fulfillment of legal, accounting, tax, administrative and contractual obligations related to the management of the site and the provision of services requested, as well as the proper management of relations with authorities, supervisory bodies and third party public entities for purposes related to particular requests, the fulfillment of legal obligations or other procedures. 

B. Quanto ai dati forniti volontariamente dall’utente: consentire al Titolare di svolgere ogni attività connessa (anche preliminare) alla fornitura dei prodotti richiesti dall’Utente, ivi incluso l’adempimento delle incombenze fiscali (es. VAT free, ove previsto), amministrativo – contabili (tra cui, a titolo esemplificativo, fatturazione, archiviazioni storiche, recupero crediti – anche attuato mediante fattorizzazione, assicurazione del credito, cessione del credito -, etc.) e l’individuazione delle caratteristiche di consumo del professionista e/o della società cliente, adempiendo alla Sua richiesta di acquisto di prodotti tramite il Sito; ovvero adempiere alla Sua richiesta di fornitura di altri servizi a valore aggiunto connessi all’acquisto dei richiamati prodotti.
Consentire al titolare la predisposizione di misure finalizzate alla tutela contro il rischio di credito, incluse le attività finalizzate all’identificazione del Cliente e della sua affidabilità finanziaria. Consentire al Titolare l’adempimento di obblighi legali, contabili, fiscali, amministrativi e contrattuali connessi all’erogazione dei servizi richiesti, nonché la corretta gestione dei rapporti con autorità, organi di controllo ed enti pubblici terzi per finalità connesse a particolari richieste, all’adempimento di obblighi di legge o ad altre procedure. Salvo che l’Utente dia al Titolare uno specifico e facoltativo consenso al trattamento dei propri dati per ulteriori finalità, i dati personali dell’Utente saranno utilizzati dal Titolare al fine esclusivo di accertare l’identità dell’Utente (anche tramite validazione dell’indirizzo di posta elettronica), evitando così possibili truffe o abusi, e contattare l’Utente per sole ragioni di servizio. I dati personali che sono necessari per il perseguimento delle finalità di trattamento descritte al presente punto B. sono indicati con un asterisco all’interno del modulo di registrazione sul Sito. 

C. Esclusivamente previo Suo libero, specifico e distinto consenso (ex art. 7 GDPR), consentire al Titolare di svolgere ricerche di mercato e analisi tese a rilevare il grado di soddisfazione della clientela sulla qualità e tipologia dei servizi resi e di iniziative relative al miglioramento dei servizi forniti, nonché di inviarLe newsletter, materiale pubblicitario e/o comunicazioni ed informazioni di natura commerciale e di marketing diretto sui nuovi prodotti messi in vendita e sui nuovi servizi offerti dal Titolare ovvero da soggetti terzi. Nonché sulle relative offerte, sugli sconti e su ogni altra iniziativa promozionale e di fidelizzazione a Lei riservata. Ciò potrà avvenire sia per mezzo di sistemi di contatto tradizionali (posta cartacea ovvero chiamate tramite operatore), che con l’uso di sistemi automatizzati di chiamata o di comunicazione di chiamata senza l’intervento di un operatore, ovvero mediante posta elettronica e/o messaggi di tipo SMS (Short Message Service), MMS, Internet, social media, e per personalizzare l’esperienza del cliente con noi in base ai suoi interessi e abitudini di acquisto (ad esempio, comunicazioni mirate) e migliorare i nostri servizi, in particolare tramite profiling, presentazione di campagne mirate simili selezionando le sue impressioni pubblicitarie attraverso i nostri siti web. In caso di mancato consenso, la possibilità di iscriversi al Sito e/o di eseguire acquisti dei prodotti tramite il Sito non sarà in alcun modo pregiudicata. In caso di consenso, l’Utente potrà in qualsiasi momento revocare lo stesso, facendone richiesta al Titolare con le modalità indicate al successivo paragrafo 10.

L’Utente potrà inoltre opporsi facilmente ad ulteriori invii di comunicazioni promozionali via Email anche cliccando sull’apposito link per la revoca del consenso, che è presente in ciascuna Email promozionale. Effettuata la revoca del consenso, Bcame invierà all’Utente un messaggio di posta elettronica per confermare l’avvenuta revoca del consenso. Qualora l’Utente intenda revocare il proprio consenso all’invio di comunicazioni promozionali via telefono, continuando tuttavia a ricevere comunicazioni promozionali via Email, o viceversa, si prega di inviare una richiesta a Bcame con le modalità indicate al successivo paragrafo 10. 

Bcame informs that, following the exercise of the right to object to the sending of promotional communications via Email, it is possible that, for technical and operational reasons (e.g. formation of contact lists already completed shortly before the Partner's receipt of the request for objection) the User continues to receive some additional promotional messages. Should the User continue to receive promotional messages after 24 hours have elapsed since the exercise of the right to object, please report the problem, using the contacts indicated in paragraph 10 below. 

D. Esclusivamente previo Suo libero, specifico e distinto consenso (ex art. 7 GDPR), consentire al Titolare il trattamento dei suoi dati per suggerirle funzionalità, prodotti e servizi che potrebbero interessarle, per identificare le sue preferenze e personalizzare la sua esperienza, per mostrarle pubblicità definita in base ai suoi interessi in relazione a funzionalità, prodotti e servizi che potrebbero interessarla; inoltre, sempre previo Suo libero, specifico e distinto consenso (ex art. 7 GDPR), consentire al Titolare.

Previo Suo libero, specifico e distinto consenso, consentire al Titolare l’analisi e l’elaborazione di informazioni finalizzate alla creazione di gruppi omogenei per gusti e comportamenti – cd. ‘profili’ – funzionali a pervenire all’identificazione del singolo utente, o più spesso di un gruppo di utenti, o del terminale da cui si collega, al fine dell’offerta, personalizzata, di beni o servizi ulteriori o affini. In caso di mancato consenso, la possibilità di iscriversi al Sito e/o di eseguire acquisiti tramite il Sito non sarà in alcun modo pregiudicata.  In caso di consenso, l’Utente potrà in qualsiasi momento revocare lo stesso, facendone richiesta a Bcame con le modalità indicate al successivo paragrafo 10. 

3. METHODS OF PROCESSING

The processing of your Data is carried out by means of the operations indicated in Article 4 No. 2) GDPR and namely: collection, recording, organization, structuring, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, deletion or destruction of Data.

Your Data are subject to both paper and electronic and/or automated processing.

The Data acquired are subject to processing, in full compliance with the law, as well as with the principles of lawfulness, correctness, transparency, non-excessiveness and protection of your confidentiality and rights.There are no plans to process Data of underage subjects. At the request of Users, the Owner will promptly delete all personal data involuntarily collected and relating to subjects under the age of 18.

4. DATA RETENTION PERIOD

Data Holders will retain Data in compliance with local laws and internal company policies and procedures for as long as necessary for the purpose of fulfilling the above purposes and to satisfy its legitimate business interests, legal obligations or to establish, exercise or defend legal rights. Once the need to retain the Data for said purposes is exhausted, the Data will be securely deleted.

In particular:

- Data collected for marketing purposes are retained until the service is terminated or the user exercises objection by unsubscribing.

- Data collected for the purpose of profiling for marketing purposes are retained until the user's request for termination and in any case within 2 years of the user's last interaction of any kind with Bcame s.r.l.

- Data collected for the purpose of providing the newsletter service are retained until the service is discontinued or the user exercises opposition by unsubscribing

- Data collected for the purpose of managing registered User services are retained until the service is terminated or the user exercises objection by unsubscribing.

In all other cases, Users' personal data will be retained for as long as is strictly necessary to fulfill the primary purposes illustrated or, in any case, as necessary for the protection in civil law of the interests of both Users and the Data Controller. 

5. LEGAL BASIS FOR PROCESSING

The processing of the aforementioned Data is necessary to enable you to navigate the site and to follow up on your requests Where necessary, for specific purposes, express user consent will be collected.

The processing of Data for marketing purposes is permissible in relation to the free movement of data as provided for in the GDPR and may take the form of activities aimed at satisfying the legitimate business interests of the Data Controller, including any business development activities (e.g. marketing, customer satisfaction, etc.) carried out by the latter.

6. DATA COMMUNICATION, DISSEMINATION AND ACCESS

Your Data may be made accessible for the purposes described above:

- to employees and collaborators of the Controllers in Italy and abroad, in their capacity as internal data processors and/or sub-processors/processors and/or system administrators;

- to other third party companies or other entities (professional firms, consultants, etc.) that carry out outsourced activities on behalf of the Owner, in their capacity as external data processors, including suppliers or entities appointed to perform ancillary or instrumental services for the purposes indicated above, with which the Owner enters into appropriate agreements.

The Owner also reserves the right to share personal data with certain third parties, including: IT providers for purposes of systems development and technical assistance; auditors and consultants to ascertain compliance with external and internal requirements; certifying bodies; legal entities, law enforcement agencies and parties in accordance with legal disclosure obligations or claims; any successors or business partners of the Holders or a company in the Holders' group in the event of a sale, transfer or other extraordinary transaction; police, armed forces and other public administrations, for the fulfillment of obligations under the law, regulations or EU legislation.

In the event that said entities are established in non-EU countries, the Data Controller ensures that the transfer of the Data outside the EU will take place in accordance with the applicable legal provisions, subject to the stipulation of the standard contractual clauses provided by the European Commission.Users have the right to obtain a list of any data processors appointed respectively by each Data Controller, by making a request to the Data Controller concerned in the manner indicated in paragraph 10 below.

7. DATA TRANSFER

I Dati saranno conservati su server ubicati all’interno dell’Unione Europea. Resta in ogni caso inteso che il Titolare, ove si rendesse necessario, ha la facoltà di condividere i dati anche con le altre società e/o di trasferire i Dati anche in altri ambiti extra-UE; in tal caso, il Titolare assicura sin d’ora che il trasferimento dei Dati extra-UE avverrà in conformità alle disposizioni di legge applicabili, previa stipula delle clausole contrattuali standard previste dalla Commissione Europea.
Il Titolare applicherà ai predetti trasferimenti tutte le tutele necessarie ai sensi della vigente normativa in materia di privacy.

8. NATURE OF DATA PROVISION AND CONSEQUENCES

Providing Data for the purposes set forth in Article 2 "A." is optional but necessary to visit and access the various features of the Site and allow proper navigation.

The provision of Data for the purposes set forth in Article 2 "B." is likewise optional but necessary to enable Bcame s.r.l. to fulfill your requests.

The provision of Data for the purpose referred to in Article 2 "C." is optional but not necessary in order to visit and access the various features of the Site. You may therefore decide not to provide any Data or to subsequently deny the possibility of processing Data already provided: in this case, you will not be able to receive the requested information, newsletters, commercial communications and advertising material inherent to the services offered by the Data Controller.

The provision of Data for the purpose referred to in Article 2 "D." is optional but not necessary in order to visit and access the various features of the Site. You may, therefore, decide not to provide any Data or later deny the possibility of processing Data already provided.

9. RIGHTS OF THE DATA SUBJECT

In your capacity as a data subject, you have the rights set forth in Articles 13(2)(b), (c) and (d), 15, 16, 17, 18, 19 and 21 GDPR, namely, the rights to:

- obtain confirmation of the existence or otherwise of Data concerning you, even if not yet registered, and their communication in intelligible form;

- Obtain the indication of: a) the origin of the Data; b) the purposes and methods of processing; c) the logic applied in case of processing carried out with the aid of electronic instruments; d) the identification details of the relevant Data Controller, Data Protection Officer, data processors and designated representative pursuant to Article 3, paragraph 1, GDPR; e) the subjects or categories of subjects to whom the Data may be communicated or who may become aware of them as designated representative in the territory of the State and data processors;

- obtain: a) the updating, rectification or, when interested, the integration of the Data; b) the cancellation, transformation into anonymous form or blocking of personal data processed in violation of the law, including those that do not need to be kept in relation to the purposes for which the data were collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected;

- object, in whole or in part: a) for legitimate reasons, to the processing of Data concerning you, even if pertinent to the purpose of collection; b) to the processing of Data concerning you for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication, through the use of automated calling systems without the intervention of an operator by Email and/or through traditional marketing methods by telephone and/or paper mail. It should be noted that the data subject's right to object, set out in point b) above, for direct marketing purposes through automated modalities extends to traditional ones and that, in any case, the possibility for the data subject to exercise the right to object even partially remains unaffected. Therefore, the data subject may decide to receive only communications by traditional means or only automated communications or neither type of communication;

- where applicable, also has the rights under Articles 16 - 21 GDPR (Right to rectification, right to be forgotten, right to restrict processing, right to data portability, right to object), as well as the right to complain to the Data Protection Authority;

- Revoke at any time any consent that may have been given.

10. MODE OF DATA EXERCISE

You may at any time exercise your rights or make a request in the following ways:

Bcame s.r.l. will comply with the requests of the Users related to the treatments referred to in paragraph 2 points A. and B and point C. and D.
